Terms of Use

These Terms of Use (“Terms”) govern your use of the Arca TCG mobile application (the “App”), provided by Alisher Akhmedzhanov (“Developer,” “we,” “us,” or “our”). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App. For support, contact us at support@arcatcg.com.

1. Eligibility and Account

You must be at least 13 years old (16 in the European Economic Area) to use the App. By creating an account, you confirm that you meet this age requirement and that the information you provide is accurate. You are responsible for activity that occurs under your account. Creating an account or otherwise using the App constitutes acceptance of these Terms.

2. License

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App for your own personal, non-commercial purposes. You may not use the App for any commercial purpose without our prior written consent.

3. Subscriptions and Billing

The App offers auto-renewing subscriptions that unlock premium features. The following terms apply:

• Payment is charged to your Apple App Store account upon confirmation of purchase.
• Subscriptions automatically renew at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours prior to the end of the current period.
• The subscription price and billing period are shown in the App before purchase.
• You can manage, cancel, or restore your subscription through your Apple App Store account settings, with cancellation taking effect at the end of the current billing period.
• Refunds, where available, are handled by Apple in accordance with the App Store’s policies, and we do not process refunds directly.
• If a free trial is offered, any unused portion is forfeited when you purchase a subscription, and the subscription begins automatically at the end of the trial unless canceled beforehand.

4. Acceptable Use

You agree not to:

• copy, scrape, or harvest data from the App;
• reverse engineer, decompile, or disassemble the App;
• interfere with or disrupt the App or its servers;
• abuse, overload, or attempt to gain unauthorized access to the card-scanning endpoint or any backend service; or
• use the App in violation of any applicable law.

5. Price and Valuation Disclaimer

Card prices and valuations shown in the App are estimates provided by third parties (such as TCGplayer / TCGCSV) and may be inaccurate, outdated, or incomplete. They are provided for informational purposes only, are not financial or investment advice, and do not constitute an offer to buy or sell any item. You are solely responsible for any decisions you make based on this information.

6. Intellectual Property and Unofficial Status

Pokémon, card names, card images, and related marks are trademarks and copyrights of Nintendo, Creatures Inc., GAME FREAK Inc., and The Pokémon Company. Arca TCG is an unofficial, fan-made application and is not affiliated with, endorsed, sponsored, or approved by any of these entities. Card data is provided courtesy of its respective data source, which is credited within the App. All other content and software in the App are owned by the Developer or its licensors.

7. User Content

You retain ownership of the collection data and other content you create in the App. By using the App, you grant us a limited license to store, process, synchronize, and display that content solely to provide the App’s functionality to you across your devices.

8. Disclaimer of Warranties

The App is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or that card identifications or valuations will be accurate.

9. Limitation of Liability

To the maximum extent permitted by law, the Developer will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue, arising out of or related to your use of the App. Our total liability for any claim relating to the App will not exceed the amount you paid us, if any, in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless the Developer from any claims, damages, liabilities, and expenses arising out of your use of the App or your violation of these Terms.

11. Apple-Required Terms

These Terms are between you and the Developer only, not with Apple. Apple is not responsible for the App or its content. To the extent we do not provide our own end user license agreement (EULA), Apple’s standard Licensed Application End User License Agreement applies. You acknowledge that Apple has no obligation to provide maintenance or support for the App; that in the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any), and to the maximum extent permitted by law Apple has no other warranty obligation with respect to the App; that Apple is not responsible for addressing any claims relating to the App, including product liability, legal or regulatory compliance, and consumer protection claims; that Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party intellectual property infringement claim relating to the App; and that Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

12. Termination

We may suspend or terminate your access to the App at any time if you violate these Terms or for any other reason. You may stop using the App at any time and may delete your account through the in-app account deletion option.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which the Developer resides, without regard to its conflict-of-laws principles.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date above and, where appropriate, notify you within the App. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
